These Website Terms of Use (“Terms”) govern your use of parkscabinets.com and related webpages operated by Parks Cabinet Shop, Inc., doing business as Parks Cabinets (“Parks Cabinets,” “we,” “us,” or “our”). By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.

1. Website Information Only

The website provides general information about Parks Cabinets, our work, our process, and ways to contact us. Website content is not an offer, binding quote, design commitment, production schedule, warranty, or project agreement. Colors, wood grain, finishes, dimensions, photographs, renderings, product availability, lead times, and other details may vary.

Submitting a project inquiry, uploading materials, requesting support, or communicating through the website does not create a customer relationship, reserve production capacity, obligate Parks Cabinets to accept a project, or create a binding agreement. A project becomes binding only through the separate written documents executed or accepted for that project.

2. Separate Project Agreements Control

These Terms apply only to the website. They do not replace or modify any estimate, proposal, contract, change order, payment term, warranty, installation agreement, delivery term, approval, or other project-specific document. If these Terms conflict with an executed project agreement, the project agreement controls for that project.

3. Project Inquiries, Customer Intake Forms, and Uploaded Materials

You agree to provide accurate information and keep it reasonably current. If you submit customer intake information about another person or project participant, you represent that you are authorized to provide it for project onboarding, administration, communication, billing, and coordination. If you upload plans, drawings, photographs, inspiration images, PDFs, or other materials, you represent that you have the right to provide them and that our receipt and review of them will not violate another person’s rights.

You retain any ownership rights you have in materials you submit. You grant Parks Cabinets a nonexclusive, royalty-free license to receive, store, reproduce, review, and share those materials with authorized employees, service providers, and project participants as reasonably necessary to evaluate your inquiry, onboard and administer an accepted project, communicate with you and authorized project participants, and provide requested services. We will not use customer-submitted project materials for public marketing solely because they were uploaded through the website.

Do not upload malicious code, unlawful content, confidential information you are not authorized to disclose, or highly sensitive personal information. We may remove, reject, or decline to review uploaded materials at our discretion.

4. Ownership of Website Content

The website and its text, photographs, graphics, logos, designs, layouts, video, and other content are owned by Parks Cabinets or used with permission and are protected by intellectual-property laws. You may view and print website content for personal, noncommercial evaluation of Parks Cabinets. You may not reproduce, publish, modify, distribute, sell, license, scrape, frame, or commercially exploit website content without our prior written permission.

5. Acceptable Use

You may not:

  • Use the website for unlawful, fraudulent, harassing, abusive, or deceptive purposes.
  • Attempt to gain unauthorized access to the website, forms, servers, files, accounts, or networks.

When you submit a form, electronically type your name as a signature, check a consent box, or communicate electronically, you agree that the electronic action may serve as your signature or consent for the stated purpose. You represent that the information is accurate and that you are authorized to provide the consent.

The website may use or link to third-party services, including mapping, video, social media, security, email, form, font, and communication providers. We do not control and are not responsible for third-party content, availability, terms, or privacy practices. Your use of a third-party service is subject to that provider’s terms.

8. Website Availability and Changes

We may change, suspend, restrict, or discontinue any part of the website without notice. We do not guarantee uninterrupted access, error-free operation, or that all content will always be current or complete.

9. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PARKS CABINETS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY. Nothing in this section disclaims any written warranty expressly provided in a separate project agreement.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PARKS CABINETS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM WEBSITE USE, WEBSITE UNAVAILABILITY, THIRD-PARTY SERVICES, OR RELIANCE ON WEBSITE CONTENT. This limitation does not apply where prohibited by law and does not alter liability established in a separate project agreement.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold Parks Cabinets harmless from claims, losses, liabilities, and reasonable expenses arising from your unlawful website use, your violation of these Terms, or materials you submit without necessary authorization.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any dispute arising solely from these Terms or website use must be brought in a state or federal court serving Henry County, Missouri, unless applicable law requires otherwise. Project disputes remain governed by the applicable project agreement.

13. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of that provision or any other provision.

14. Changes to These Terms

We may update these Terms by posting a revised version and changing the effective date. Your continued use of the website after revised Terms take effect constitutes acceptance to the extent permitted by law.
